مثلا کسی نے 4000 روپے میں اسسٹنٹ والا پیکچ خریدا،اب اس کو روزانہ  4 ٹاسک دیے جائیں گے ،ان کو پورا کرنے پر 160 روپے ملیں گے ،یوں ماہانہ 4800 اور سالانہ 57600 روپے کمائی ہوگی۔

دوسرا طریقہ  یہ ہے کہ اس ایپ میں اپنا اکاؤنٹ بنانے کے بعد دوسرے لوگوں کو دعوت دیں ،پہلے شخص  کے توسط سے جتنے لوگ اکاؤنٹ بنائیں گے اس کا کمیشن پہلے شخص  کو ملے گا اور پھر  یہ سلسلہ  چین در چین چار لوگوں تک چلتا رہےگا یعنی ہر نئے اکاؤنٹ بنانے والے کے اوپر تین لوگوں تک  چوتھے اکاؤنٹ بنانے والے کی وجہ سے  کمیشن ملے گا ۔

مذکورہ تفصیل کی روشنی میں  آپ کے سوال کا جواب یہ ہے کہ LAM ویب سائٹ  کے ذریعہ کمانا مندرجہ ذیل وجوہات کی بنا پر ناجائز ہے:

1۔مذکورہ ایپ کی جانب سے روزانہ  ٹاسک ملتا ہے اور اس کو پورا  کرنے پر بطور معاوضہ پیسہ دیا جاتا ہے یہ بظاہر اجارہ کا معاملہ ہے ؛لیکن اس  میں خرابی یہ ہے کہ اجارہ میں اجیر سے کوئی معاوضہ نہیں لیا جاتا بلکہ اجیر کو اس کے عمل پر محنتانہ دیا جاتا ہے جبکہ مذکورہ ایپ میں اجیر کو پہلے رقم پیش کرنی ہوتی ہے اور اس پر اس کو ٹاسک ملتا ہے جتنی رقم زیادہ ہوگی اسی حساب سے روزانہ کی کمائی بھی بڑھے گی ۔

2۔ اس میں ایسے لوگ  اشتہارات کو دیکھتے ہیں  جن کا چیزیں لینے کا کوئی ارادہ ہی نہیں، بائع کو ایسے دیکھنے والوں کی تعداد میں اضافہ دکھانا جو کہ کسی طرح بھی خریدار نہیں، یہ بیچنے والے کے ساتھ  ایک قسم کا دھوکا ہے۔

3۔  بعض ویڈیوز میں جاندار کی تصاویر بھی ہوتی ہیں ،جان دار کی تصویر  کسی بھی طرح کی ہو اس کا دیکھنا جائز نہیں؛ لہذا اس پر جو اجرت  لی جائے گی وہ بھی جائز نہ ہوگی۔

4۔ ان اشتہارات میں بسا اوقات  خواتین کی تصاویر بھی ہوتی ہیں جن کا دیکھنا بدنظری کی وجہ سے مستقل گناہ ہے۔

5۔  نیز اس معاملے میں جس طریق پر اس سائٹ کی پبلسٹی کی جاتی ہے جس میں پہلے اکاؤنٹ بنانے والے کوہر نئے اکاؤنٹ بنانے والے پر کمیشن ملتا رہتا ہے جب کہ  اس نے  اس نئےاکاؤنٹ بنوانے میں کوئی عمل نہیں کیا ، اس بلا عمل کمیشن لینے کا معاہدہ کرنا اور  اس پر اجرت لینا بھی جائز نہیں۔

شریعت میں بلا  محنت کی کمائی   کی حوصلہ شکنی کی گئی ہے اور  اپنی محنت   کی کمائی   حاصل کرنے کی ترغیب ہے  اور اپنے ہاتھ کی کمائی کو افضل کمائی قراردیا ہے ، لہٰذا  حلال کمائی کے لیے کسی بھی  ایسے طریقے کو اختیار کرنا چاہیے  کہ جس میں اپنی محنت شامل ہو ایسی کمائی زیادہ بابرکت ہوتی ہے،چناں چہ مذکورہ ایپلیکیشن کے ذریعے پیسے کمانا ناجائز ہے ۔

حدیث شریف میں ہے:

" عن سعيد بن عمير الأنصاري، قال: سئل رسول الله صلّى الله عليه وسلم أي الكسب أطيب؟ قال: " عمل الرجل بيده، وكلّ بيع مبرور ".

(شعب الإيمان ،فصل في عذاب القبر،التوكل بالله عزوجل والتسليم لأمره تعالي فى كل شيئ،2/ 434، ط: الرشد )

ترجمہ:"آپ ﷺ سے پوچھا گیا  کہ سب سے پاکیزہ کمائی کو ن سی ہے؟تو آپ ﷺنے فرمایا کہ  آدمی کا  خود  اپنے ہاتھ سے محنت کرنا اور ہر جائز اور مقبول بیع۔"

فتاوی شامی میں ہے :

"هي لغة: اسم للأجرة وهو ما يستحق على عمل الخير ولذا يدعى به، يقال أعظم الله أجرك. وشرعا (تمليك نفع) مقصود من العين (بعوض) حتى لو استأجر ثيابا أو أواني ليتجمل بها أو دابة ليجنبها بين يديه أو دارا لا ليسكنها أو عبدا أو دراهم أو غير ذلك لا ليستعمله بل ليظن الناس أنه له فالإجارة فاسدة في الكل، ولا أجر له لأنها منفعة غير مقصودة من العين بزازية."

الفقہ الاسلامی میں ہے:

الموسوعہ الفقہیہ الکویتیہ  میں ہے :

"الإجارة على المنافع المحرمة كالزنى والنوح والغناء والملاهي محرمة، وعقدها باطل لايستحق به أجرة . ولايجوز استئجار كاتب ليكتب له غناءً ونوحاً؛ لأنه انتفاع بمحرم ... و لايجوز الاستئجار على حمل الخمر لمن يشربها، ولا على حمل الخنزير".
